Purpose Statement

To shape and drive Capitec’s Employee Relations strategy by creating a legally compliant, fair, and values aligned workplace culture that protects the organisation from labour, operational, and reputational risk that will include the collective labour space.

To interpret the Employee Relations (ER) strategy and business plan and develop and implement tactical and operational plans and practices, resolving workplace conflicts, ensuring regulatory compliance and a positive workplace culture, enabling employee engagement and delivering the ER objectives and goals.

To be responsible for the day-to-day management of the department, embed appropriate processes, practices, standards and delivery.

Experience

  • 8+ years’ experience in Employee Relations, Labour Law, or Employment Law advisory roles, with at least 3–5 years in a leadership or managerial capacity.
  • Proven experience leading ER specialists, ensuring quality, consistency, and governance in ER casework.
  • Strong background in complex litigation, including CCMA arbitration, Labour Court preparation, including matters related to collective labour disputes, and strategic dispute resolution.
  • Demonstrated ability to develop, interpret, and implement ER policies, frameworks, and governance standards across a large organisation.
  • Experience working cross‑functionally with Legal, Compliance, HR Business Partners, and senior leaders to mitigate organisational labour risk.
  • Proven ability to manage high‑risk, sensitive ER matters (sexual harassment, organisational grievances, senior‑level disputes).
  • Experience using ER analytics, trends, and data insights to identify risks, shape decisions, and drive proactive interventions.
  • Experience leading collective bargaining processes, including developing negotiation mandates, managing negotiation teams, and representing the organisation in consultations and negotiations with unions.
  • Demonstrated experience in drafting, reviewing and interpreting collective agreements, and ensuring organisational compliance with such agreements.
  • Experience managing relationships with union structures, including shop stewards, union officials, and external labour stakeholders to mitigate collective labour risk.
 

Ideal:

  • Experience in financial services, highly regulated industries, or large distributed workforces

  • LLB/Equivalent
  • Admitted Attorney

Qualifications (Ideal or Preferred)

    Knowledge

    • Expert knowledge of South African labour legislation including LRA, BCEA, EEA, OHSA, and case law.
    • Deep understanding of organisational risk management, labour‑law compliance, and regulatory frameworks.
    • Strong knowledge of collective labour dynamics, dispute resolution mechanisms, union engagement, and organisational IR strategy.
    • Knowledge of ER policy design, governance frameworks, and continuous improvement methodologies.
    • Understanding of how ER impacts organisational culture, change management, employee experience, retention, and productivity.
    • Knowledge of HRIS systems, ER data structures, and analytics tools to support evidence‑based decision‑making.
    • Deep understanding of investigation methodology, disciplinary processes, and best‑practice ER procedures.
    • Knowledge of leadership practices, team capability-building, succession planning, and performance management.
    • Mediation, negotiation and coaching techniques.
